عزائم منصة إلكترونية للوساطة التجارية تربط العملاء بمزودي خدمات إعداد وتجهيز الولائم والذبائح والوجبات المسجلين في المنصة داخل دولة الإمارات العربية المتحدة. تعمل عزائم كوسيط إلكتروني ولا تقوم بذاتها بإعداد أو تصنيع الأغذية. تُدار المنصة من قبل Azaim CENTER FOR ELECTRONIC TRANSACTIONS – عزائم مجمع للتعامل الإلكتروني، رخصة تجارية رقم CN-6779054 صادرة من دائرة التنمية الاقتصادية – أبوظبي، وعنوانها العين – شارع 18، وهي الجهة المسؤولة عن معالجة البيانات الشخصية وفق هذه السياسة.Azayem is an electronic marketplace for commercial mediation that connects customers with registered providers of majlis preparation, zabiha and catering services inside the United Arab Emirates. Azayem operates as an electronic intermediary and does not itself prepare or manufacture food. The platform is operated by Azaim A Center for Electronic Transactions – Azayem E-Transaction Complex, commercial licence no. CN-6779054 issued by the Abu Dhabi Department of Economic Development, of Al Ain – Street 18, and is the entity responsible for processing personal data under this policy.

البيانات التي نجمعهاData We Collect

قد نجمع البيانات اللازمة لتقديم الخدمة، ومنها: الاسم، رقم الهاتف، البريد الإلكتروني، الإمارة والمنطقة، عنوان أو موقع الاستلام أو التوصيل، تفاصيل الطلبات، الملاحظات، سجل الطلبات والتقييمات والشكاوى، والبيانات التقنية اللازمة لتشغيل الموقع أو التطبيق مثل نوع الجهاز، عنوان IP، معرفات الجهاز والتطبيق، إصدار نظام التشغيل، رموز الإشعارات، بيانات الجلسة والاستخدام، سجلات الأعطال والأداء، وبيانات تقنية لازمة للأمن ومكافحة الاحتيال. ولا نجمع إلا البيانات اللازمة للأغراض المبينة في هذه السياسة وفقًا للقوانين المعمول بها.We may collect the data necessary to provide the service, including: name, phone number, email address, emirate and area, the pickup or delivery address or location, order details, notes, order history, reviews and complaints, and technical data needed to operate the website or app such as device type, IP address, device and app identifiers, operating system version, notification tokens, session and usage data, crash and performance logs, and technical data required for security and anti-fraud. We collect only the data necessary for the purposes set out in this policy, in accordance with applicable laws.

بيانات الدفعPayment Data

تتم معالجة المدفوعات من خلال مزود أو مزودي خدمات دفع مرخصين أو معتمدين وفق الأنظمة المعمول بها وبحسب وسائل الدفع المتاحة في المنصة. لا تخزن عزائم بيانات البطاقات المصرفية الكاملة، إذ تُعالج مباشرة لدى مزود خدمة الدفع. وقد تحتفظ عزائم بالبيانات المرجعية اللازمة لإدارة الطلب، مثل قيمة العملية وحالتها ورقمها المرجعي وبيانات الاسترداد، دون الاحتفاظ ببيانات البطاقة الكاملة.Payments are processed through one or more licensed or approved payment service providers in accordance with applicable regulations and the payment methods available on the platform. Azayem does not store full bank card details, which are handled directly by the payment service provider. Azayem may retain the reference data needed to manage an order — such as the transaction amount, status, reference number and refund data — without retaining full card details.

الموقع الجغرافيLocation Data

قد يطلب التطبيق إذن الوصول إلى الموقع لتحديد عنوان الطلب، وإظهار مزودي الخدمة المناسبين، وتحديد إمكانية الاستلام أو التوصيل واحتساب الرسوم عند توفر الخدمة. يمكن للمستخدم إيقاف هذا الإذن في أي وقت من إعدادات جهازه وإدخال العنوان يدويًا بدلًا من ذلك. ولا تستخدم عزائم الموقع الجغرافي لأغراض لا تتصل بالخدمة إلا وفق أساس قانوني مناسب ومتى تطلب القانون ذلك.The app may request permission to access your location in order to determine the order address, show relevant service providers, establish whether pickup or delivery is available, and calculate fees where the service applies. You may withdraw this permission at any time from your device settings and enter the address manually instead. Azayem does not use location data for purposes unrelated to the service except on an appropriate legal basis and where required by law.

أغراض استخدام البيانات والأساس القانونيPurposes of Use and Legal Basis

نستخدم البيانات لإنشاء الحساب وإدارته، تنفيذ الطلبات، التواصل بشأنها، إرسال رموز التحقق والإشعارات، معالجة المدفوعات والاسترداد، تقديم الدعم، معالجة الشكاوى، تحسين المنصة وقياس أدائها، منع الاحتيال وإساءة الاستخدام، حماية أمن المنصة، والامتثال للمتطلبات القانونية والتنظيمية. وتتم المعالجة وفق المرسوم بقانون اتحادي رقم (45) لسنة 2021 بشأن حماية البيانات الشخصية، واستنادًا إلى تنفيذ الخدمة أو العقد، أو موافقة المستخدم حيث تكون مطلوبة، أو الوفاء بالتزام قانوني، أو أي أساس آخر تجيزه التشريعات المعمول بها بحسب الأحوال.We use data to create and manage your account, fulfil and communicate about orders, send verification codes and notifications, process payments and refunds, provide support, handle complaints, improve and measure the platform, prevent fraud and misuse, protect platform security, and meet legal and regulatory requirements. Processing is carried out under Federal Decree-Law No. (45) of 2021 on Personal Data Protection, on the basis of performing the service or contract, your consent where required, compliance with a legal obligation, or any other basis permitted by applicable legislation, as the case may be.

مشاركة البياناتData Sharing

قد نشارك الحد اللازم من البيانات مع مزود الخدمة المختار لتنفيذ الطلب والتوصيل عندما يقدمه، ومزودي خدمات الدفع، ومزودي الاستضافة والبنية التقنية والتحليلات والإشعارات وخدمات الدعم ومكافحة الاحتيال، وكذلك مع الجهات المختصة عندما يكون الإفصاح مطلوبًا أو مسموحًا به قانونًا. وتلتزم عزائم بقصر المشاركة على ما يلزم للغرض ذي الصلة، ولا تبيع البيانات الشخصية للمستخدمين.We may share the minimum necessary data with the selected service provider in order to fulfil and, where offered, deliver the order; with payment service providers; and with hosting, infrastructure, analytics, notification, support and anti-fraud service providers, as well as with competent authorities where disclosure is required or permitted by law. Azayem limits sharing to what is necessary for the relevant purpose and does not sell personal data to users.

نقل البيانات خارج الدولةInternational Data Transfers

قد تُخزن البيانات أو تُعالج لدى مزودي خدمات تقنية أو دفع أو دعم موجودين خارج دولة الإمارات العربية المتحدة. وعند حدوث نقل دولي للبيانات، تتخذ عزائم الإجراءات والضمانات التي تتطلبها التشريعات الإماراتية لحماية البيانات الشخصية، بما في ذلك التحقق من وجود مستوى حماية مناسب أو استخدام أي آلية أخرى يجيزها القانون بحسب الحالة. وقد تشمل أغراض النقل تشغيل المنصة والاستضافة والدفع والإشعارات والتحليلات والدعم والأمن التقني.Data may be stored or processed by technology, payment or support providers located outside the United Arab Emirates. Where an international transfer occurs, Azayem takes the measures and safeguards required by UAE data protection legislation, including verifying an appropriate level of protection or using any other mechanism permitted by law, as applicable. Purposes of transfer may include operating the platform, hosting, payment, notifications, analytics, support and technical security.

ملفات تعريف الارتباط وأدوات التحليلCookies and Analytics

قد يستخدم الموقع والتطبيق ملفات تعريف الارتباط (Cookies) وتقنيات مشابهة وأدوات تحليل تابعة لأطراف ثالثة لتشغيل الخدمة، حفظ التفضيلات، قياس الأداء، اكتشاف الأعطال وتحسين تجربة الاستخدام. وتدار ملفات الارتباط أو الأدوات غير الضرورية وفق الموافقات المطلوبة قانونًا متى كانت واجبة، ويمكن للمستخدم التحكم في بعض هذه الأدوات من إعدادات المتصفح أو الجهاز، وقد يؤثر تعطيل الضروري منها على بعض وظائف المنصة.The website and app may use cookies, similar technologies and third-party analytics tools to operate the service, store preferences, measure performance, detect faults and improve the user experience. Non-essential cookies or tools are managed in line with any consent required by law, and you may control some of these tools from your browser or device settings; disabling strictly necessary ones may affect certain platform functions.

حماية البياناتData Security

تتخذ عزائم إجراءات تقنية وتنظيمية مناسبة ومتناسبة مع المخاطر لحماية البيانات من الوصول أو الاستخدام أو التعديل أو الإفصاح أو الفقد غير المصرح به. وفي حال وقوع خرق يمس البيانات الشخصية، تتخذ عزائم إجراءات الاحتواء والتقييم والمعالجة، وتقوم بالإخطارات المطلوبة للمستخدمين المتأثرين والجهات المختصة متى أوجب القانون ذلك.Azayem maintains technical and organisational measures that are appropriate and proportionate to the risk, protecting data against unauthorised access, use, alteration, disclosure or loss. In the event of a personal data breach, Azayem undertakes containment, assessment and remediation, and issues the notifications required to affected users and competent authorities where the law requires it.

الاحتفاظ بالبياناتData Retention

نحتفظ بالبيانات فقط للمدة اللازمة لتحقيق الأغراض التي جُمعت من أجلها، والوفاء بالالتزامات القانونية والتنظيمية والضريبية والمحاسبية، وتسوية النزاعات وحماية الحقوق. وتُحفظ السجلات المالية والفواتير وغيرها من السجلات للمدد التي تفرضها التشريعات المعمول بها. وعند طلب حذف الحساب، تُحذف البيانات التي لا يلزم الاحتفاظ بها أو تُجعل غير قابلة للتعريف خلال مدة معقولة لا تتجاوز 30 يومًا من استكمال التحقق من الطلب، ما لم يتطلب القانون أو نزاع أو مطالبة قائمة الاحتفاظ ببعضها مدة أطول.We retain data only for as long as is necessary to fulfil the purposes for which it was collected, to meet legal, regulatory, tax and accounting obligations, and to settle disputes and protect rights. Financial records, invoices and other records are retained for the periods required by applicable legislation. When you request account deletion, data that need not be retained is deleted or anonymised within a reasonable period not exceeding 30 days of completing verification, unless the law, a dispute or a pending claim requires certain data to be retained for longer.

حقوق المستخدمUser Rights

يجوز للمستخدم ممارسة الحقوق المقررة له بموجب التشريعات الإماراتية المعمول بها، بحسب شروط كل حق، بما في ذلك طلب الحصول على المعلومات أو الوصول إلى البيانات، ونقلها حيث ينطبق، وتصحيحها أو تحديثها، ومحوها أو تقييد معالجتها أو الاعتراض على بعض صور المعالجة، وسحب الموافقة عندما تكون المعالجة قائمة عليها، دون أن يؤثر السحب على مشروعية المعالجة السابقة. وقد تطلب عزائم التحقق من الهوية قبل تنفيذ الطلب، وتتعامل معه خلال المدد القانونية المعمول بها. ويمكن للمستخدم حذف حسابه من إعدادات التطبيق متى كانت الخاصية متاحة. ويجوز له تقديم شكوى إلى الجهة المختصة بحماية البيانات وفق الإجراءات المعمول بها.You may exercise the rights granted to you under applicable UAE legislation, subject to the conditions of each right, including requesting information or access to your data, portability where applicable, correction or updating, erasure or restriction of processing, and objection to certain forms of processing, and withdrawing consent where processing relies on it — without affecting the lawfulness of processing carried out before withdrawal. Azayem may request identity verification before acting on a request and will handle it within the applicable statutory periods. You may delete your account from the app settings where that feature is available. You may also lodge a complaint with the competent data protection authority under the applicable procedures.

الرسائل والإشعاراتMessages and Notifications

قد ترسل عزائم رسائل تشغيلية لازمة للخدمة، مثل رموز التحقق وتأكيدات الطلب وتحديثات الدفع والاسترداد والتوصيل والأمن، ولا تُعامل هذه الرسائل باعتبارها رسائل تسويقية متى كان غرضها تشغيليًا. أما الرسائل النصية أو الإلكترونية التسويقية والعروض الترويجية فتُرسل بعد الحصول على الموافقة الصريحة المسبقة متى كانت مطلوبة، مع الاحتفاظ بسجل قابل للإثبات للموافقة، وتوفير وسيلة مجانية وفعالة لإلغاء الاشتراك. وتلتزم عزائم بالنسبة للرسائل النصية التسويقية بالأوقات التنظيمية المسموح بها، بما في ذلك الفترة من الساعة 7 صباحًا إلى 9 مساءً بتوقيت دولة الإمارات ما دام هذا المتطلب نافذًا. ولا تكون الموافقة على هذه الشروط بذاتها موافقة تلقائية على التسويق.Azayem may send operational messages necessary for the service, such as verification codes, order confirmations, and payment, refund, delivery and security updates. These are not treated as marketing messages where their purpose is operational. Marketing text or email messages and promotional offers are sent only after obtaining explicit prior consent where required, with a verifiable record of that consent and a free and effective means of unsubscribing. Azayem complies with the permitted regulatory hours for marketing text messages, including the period from 7:00 a.m. to 9:00 p.m. UAE time, for as long as that requirement remains in force. Accepting these terms does not by itself constitute consent to marketing.

الأطراف الثالثةThird Parties

قد تحتوي المنصة على خدمات أو روابط أو مكونات تقنية مقدمة من أطراف ثالثة. ويخضع استخدام تلك الجهات للبيانات لسياساتها وشروطها بحسب دور كل جهة، مع بقاء التزامات عزائم القانونية فيما يتعلق بالمعالجة التي تكون مسؤولة عنها.The platform may contain services, links or technical components provided by third parties. The use of such providers is subject to their own policies and terms according to each provider's role, while Azayem's legal obligations remain in respect of the processing it is responsible for.

سن الاستخدام والقُصّر وبيانات الأطفالAge, Minors and Children's Data

يجوز استخدام المنصة وفقًا للقوانين المعمول بها في دولة الإمارات العربية المتحدة. وإذا كان المستخدم قاصرًا، فيجب أن يكون استخدامه للمنصة بإذن ولي أمره أو الوصي القانوني عليه وتحت إشرافه، وأن يطلع ولي الأمر أو الوصي على هذه السياسة والشروط ويوافق عليهما قبل استخدام القاصر للمنصة. وعند استخدام وسيلة دفع لا تخص المستخدم، يجب أن يكون استخدامها بإذن من صاحبها وفقًا للقانون. وبالنسبة إلى الأطفال دون سن الثالثة عشرة (13)، لا تجمع عزائم أو تعالج أو تشارك بياناتهم الشخصية إلا وفق المتطلبات القانونية واجبة التطبيق، بما في ذلك الحصول على موافقة صريحة وموثقة وقابلة للتحقق من ولي الأمر أو القائم على رعاية الطفل متى كانت هذه الموافقة مطلوبة، وتوفير وسيلة ميسرة لسحبها. ولا تستخدم بيانات الأطفال للإعلانات الإلكترونية الموجهة إليهم أو لأغراض تجارية محظورة قانونًا.The platform may be used in accordance with the laws applicable in the United Arab Emirates. If you are a minor, your use of the platform must be with the permission and under the supervision of your parent or legal guardian, who must read and agree to this policy and these terms before you use the platform. If you use a payment method that is not yours, you must do so with the owner's permission and in accordance with the law. In respect of children under the age of thirteen (13), Azayem does not collect, process or share their personal data except as required by applicable law, including obtaining verifiable, documented and explicit consent from the parent or guardian where such consent is required, and providing an accessible means of withdrawing it. Children's data is not used for targeted advertising to them or for any commercially prohibited purpose.

تحديث السياسةPolicy Updates

يجوز تحديث هذه السياسة عند تطوير الخدمات أو تغير المتطلبات القانونية أو التشغيلية. ويُنشر تاريخ سريان النسخة المحدثة، وعند وجود تغيير جوهري يؤثر بصورة مهمة في طريقة معالجة البيانات، تتخذ عزائم وسيلة إخطار مناسبة وتطلب موافقة جديدة إذا كان القانون يتطلب ذلك.This policy may be updated as services develop or legal and operational requirements change. The effective date of the updated version is published, and where a material change significantly affects how data is processed, Azayem will provide appropriate notice and seek fresh consent where the law requires it.

قبول الشروطAcceptance of These Terms

باستخدام موقع أو تطبيق عزائم أو إنشاء حساب أو تقديم طلب، يقر المستخدم بأنه قرأ هذه الشروط والأحكام وفهمها ووافق عليها. وإذا لم يوافق المستخدم عليها فعليه عدم استخدام الخدمة. ولا يُفسر أي حكم في هذه الشروط بما ينتقص من الحقوق الإلزامية المقررة للمستهلك بموجب القوانين المعمول بها في دولة الإمارات العربية المتحدة.By using the Azayem website or app, creating an account or placing an order, you confirm that you have read, understood and agreed to these terms. If you do not agree to them, you must not use the service. No provision of these terms shall be construed as limiting the mandatory rights granted to consumers under the laws applicable in the United Arab Emirates.

طبيعة منصة عزائمNature of the Azayem Platform

عزائم منصة وساطة إلكترونية تربط العميل بمزودي خدمات إعداد وتجهيز الولائم والذبائح والوجبات. لا تقوم عزائم بذاتها بإعداد أو تصنيع الأغذية ما لم يُذكر صراحة خلاف ذلك في خدمة معينة، ويكون مزود الخدمة مسؤولًا عن تجهيز المنتجات وجودتها وسلامتها ومطابقتها للطلب والاشتراطات المطبقة عليه. تتحقق عزائم من بيانات وترخيص مزود الخدمة عند انضمامه وفق إجراءاتها، وتُنظم العلاقة بين عزائم ومزودي الخدمة باتفاقية مستقلة. ولا يخل وصف عزائم كمنصة وساطة بأي التزام أو مسؤولية تقع عليها مباشرة بموجب القوانين واللوائح واجبة التطبيق.Azayem is an electronic mediation platform connecting customers with providers of majlis, zabiha and catering services. Azayem does not itself prepare or manufacture food unless expressly stated otherwise in a particular service, and the service provider is responsible for preparing the products and for their quality, safety and conformity to the order and the applicable requirements. Azayem verifies a service provider's details and licence upon onboarding according to its procedures, and the relationship between Azayem and service providers is governed by a separate agreement. Describing Azayem as a mediation platform does not exempt it from any obligation or liability falling directly on it under applicable laws and regulations.

الحساب وبيانات المستخدمAccount and User Data

يلتزم المستخدم بتقديم معلومات صحيحة ومحدثة والمحافظة على سرية بيانات الدخول ورموز التحقق، وإبلاغ عزائم عند الاشتباه في استخدام غير مصرح به للحساب. ويتحمل المستخدم مسؤولية الاستخدام الصادر من حسابه بالقدر الذي يسمح به القانون. ويمكن حذف الحساب وفق الآلية المتاحة، مع بقاء الطلبات القائمة والالتزامات والحقوق التي نشأت قبل الحذف.You must provide accurate and current information, keep your login credentials and verification codes confidential, and inform Azayem if you suspect unauthorised use of your account. You are responsible for activity originating from your account to the extent permitted by law. The account may be deleted through the available mechanism, without affecting existing orders and any obligations or rights that arose before deletion.

الطلبات وتأكيدهاOrders and Confirmation

يختار العميل مزود الخدمة والمنتجات والخيارات المتاحة، بما في ذلك نوع الذبيحة وطريقة الطبخ والأرز والإضافات والتاريخ والوقت والاستلام أو التوصيل عند توفره. ويجب على العميل مراجعة تفاصيل الطلب والسعر النهائي قبل الإرسال. لا يشكل إرسال الطلب وحده قبولًا نهائيًا له؛ ويصبح الطلب مؤكدًا بعد نجاح عملية الدفع أو التفويض المالي بحسب آلية الدفع، وقبول مزود الخدمة للطلب، وإصدار تأكيد الطلب عبر المنصة. وإذا لم يقبل مزود الخدمة الطلب أو تعذر تأكيده، تُلغى العملية أو يُعاد المبلغ/يُرفع التفويض وفق آلية مزود خدمة الدفع.The customer selects the service provider, products and available options, including the type of zabiha, cooking method, rice, extras, date, time, and pickup or delivery where offered. The customer must review the order details and final price before submitting. Submission alone does not constitute final acceptance: an order becomes confirmed once payment or financial authorisation succeeds under the relevant payment method, the service provider accepts the order, and the order confirmation is issued through the platform. If the service provider does not accept the order, or it cannot be confirmed, the transaction is cancelled or the amount is refunded / the authorisation released in accordance with the payment service provider's mechanism.

الحساسية الغذائية والمتطلبات الخاصةAllergies and Special Requirements

يلتزم العميل بالإفصاح في ملاحظات الطلب عن أي حساسية غذائية معروفة أو متطلبات خاصة ذات صلة. ويلتزم مزود الخدمة بتقديم المعلومات المتاحة والصحيحة عن المكونات ومسببات الحساسية عند طلبها أو عندما يوجب القانون الإفصاح عنها. ولا تتحمل عزائم أو مزود الخدمة آثار حساسية لم يفصح عنها العميل، إلا إذا كانت المسؤولية ناشئة عن معلومات غير صحيحة أو مضللة، أو إخلال بمتطلب إلزامي، أو مسؤولية لا يجوز قانونًا استبعادها أو الحد منها.The customer must disclose any known food allergy or relevant special requirement in the order notes. The service provider must provide the information available to it and accurate information about ingredients and allergens when asked, or where the law requires disclosure. Neither Azayem nor the service provider is liable for the consequences of an allergy that was not disclosed, except where the liability arises from inaccurate or misleading information, breach of a mandatory requirement, or a liability that cannot lawfully be excluded or limited.

الصور والأوصاف والأوزان والسعة التقديريةImages, Descriptions, Weights and Estimated Capacity

الصور المعروضة للمنتجات والولائم تكون لأغراض توضيحية ما لم يُذكر صراحة أنها تمثل المنتج المحدد، وقد يختلف الشكل النهائي أو التقديم بصورة معقولة بسبب طبيعة إعداد الطعام. أما النوع أو العدد أو الوزن أو الحجم أو الخيارات التي يعلن عنها صراحة ضمن الطلب فتكون وفق الوصف المعروض وأي نطاق أو هامش تقريبي معلن. وأي بيان من قبيل «يكفي لعدد معين من الأشخاص» هو تقدير إرشادي يعتمد على طبيعة المناسبة وكميات الاستهلاك ولا يعد ضمانًا لعدد محدد من الضيوف، ما لم يُنص صراحة على خلاف ذلك.Images of products and feasts are illustrative unless expressly stated to represent the specific product, and the final presentation may reasonably differ because of the nature of food preparation. The type, count, weight, size or options expressly stated in the order are as described, subject to any stated range or margin. A statement such as “serves a number of people” is an indicative estimate based on the nature of the occasion and consumption levels, and is not a guarantee of a specific number of guests unless expressly stated otherwise.

الأسعار ورسوم الخدمة والضرائبPrices, Service Fees and Taxes

تُعرض أسعار المنتجات والخدمات ورسوم التوصيل وغيرها من المبالغ الواجبة قبل تأكيد الطلب. تُضاف رسوم خدمة منصة عزائم بقيمة 30 درهمًا إماراتيًا على كل طلب، وتظهر ضمن ملخص الطلب قبل الدفع. وتُطبق ضريبة القيمة المضافة على رسوم وخدمات عزائم أو منتجات مزود الخدمة متى كانت واجبة وفق التشريعات الضريبية وحالة التسجيل الضريبي ذات الصلة، وتظهر الضرائب الواجبة وفق المتطلبات القانونية. تُسترد رسوم خدمة عزائم إذا ألغى مزود الخدمة الطلب أو إذا ألغى العميل ضمن المهلة التي تمنحه حق الاسترداد وفق هذه الشروط، ما لم يوجد حكم قانوني آخر واجب التطبيق.Product and service prices, delivery fees and other applicable amounts are displayed before the order is confirmed. A platform service fee of thirty (30) UAE dirhams is added to each order and appears in the order summary before payment. Value added tax is applied to Azayem's fees and services, or to the service provider's products, where required under applicable tax legislation and the relevant tax registration status, and applicable taxes are shown as required by law. Azayem's service fee is refunded if the service provider cancels the order, or if you cancel within the period that gives you a right to a refund under these terms, unless another mandatory legal provision applies.

الأخطاء الواضحة في الأسعار أو المعلوماتObvious Errors in Prices or Information

تبذل عزائم ومزودو الخدمة عناية معقولة لضمان صحة الأسعار والمعلومات. وإذا ظهر خطأ تقني أو كتابي واضح في السعر أو وصف جوهري للمنتج قبل التنفيذ، يجوز تعليق الطلب والتحقق منه وإبلاغ العميل. ولا يُلزم العميل بسعر مصحح دون موافقته؛ فإذا لم يوافق على السعر أو الوصف المصحح أو تعذر تنفيذ الطلب كما تم تأكيده، يُلغى الطلب ويُعاد المبلغ المستحق وفق القانون وآلية الدفع. ولا يخل ذلك بحقوق المستهلك المتعلقة بالمعلومات أو الأسعار المضللة أو غير الصحيحة.Azayem and service providers use reasonable care to ensure the accuracy of prices and information. If an obvious technical or typographical error appears in the price or in a material product description before fulfilment, the order may be suspended, verified and the customer notified. You are not bound by a corrected price without your agreement: if you do not accept the corrected price or description, or the order cannot be fulfilled as confirmed, the order is cancelled and any amount due is refunded in accordance with the law and the payment mechanism. Nothing here limits consumer rights in respect of misleading or incorrect information or prices.

الدفع والتسوية الماليةPayment and Financial Settlement

يتم الدفع باستخدام وسائل الدفع الإلكترونية المتاحة في المنصة، وتخضع معالجة عمليات الدفع لشروط مزود خدمة الدفع. تتم عمليات الدفع والتحصيل والتسوية من خلال مزود أو مزودي خدمات دفع مرخصين أو معتمدين وفق الأنظمة المعمول بها في دولة الإمارات وبحسب الهيكل التشغيلي المعتمد للمنصة. لا تستلم عزائم ولا تحتفظ في حساباتها البنكية بأموال مستحقة لمزودي الخدمة، ويتولى مزود خدمة الدفع معالجة المدفوعات وتسوية مستحقات الأطراف وفق الترتيبات المعتمدة معه، بما في ذلك تحويل صافي مستحقات مزود الخدمة وتحويل رسوم أو مستحقات عزائم بصورة منفصلة بحسب الاتفاقيات المعمول بها. ولا يُفهم من هذه الشروط أن عزائم تقدم بنفسها خدمة دفع منظمة أو تحتفظ بأموال التجار. ولا تخزن عزائم بيانات البطاقة المصرفية الكاملة.Payment is made using the electronic payment methods available on the platform, and payment processing is subject to the payment service provider's terms. Payment, collection and settlement are carried out through one or more licensed or approved payment service providers in accordance with the regulations applicable in the UAE and the operating structure approved for the platform. Azayem does not receive or hold in its bank accounts monies due to service providers; the payment service provider processes payments and settles the parties' entitlements under the arrangements agreed with it, including transferring the service provider's net entitlement and transferring Azayem's fees or entitlements separately, as agreed. Nothing in these terms should be understood as Azayem itself providing a regulated payment service or holding merchant funds. Azayem does not store full bank card details.

إلغاء العميل والاستردادCustomer Cancellation and Refund

يُقصد بموعد التنفيذ وقت التسليم أو الاستلام المحدد في الطلب المؤكد. ويتم الإلغاء من خلال الوسيلة التي توفرها المنصة:The fulfilment time means the delivery or collection time specified in the confirmed order. Cancellation is carried out through the means provided by the platform:

• • الإلغاء قبل ثماني (8) ساعات أو أكثر من موعد التنفيذ: استرداد كامل المبلغ المدفوع عن الطلب بما فيه رسوم خدمة عزائم.• Cancellation eight (8) hours or more before the fulfilment time: a full refund of the amount paid for the order, including Azayem's service fee.
• • الإلغاء قبل أقل من ثماني (8) ساعات من موعد التنفيذ: لا يكون العميل مستحقًا للاسترداد بسبب بدء التجهيز والالتزامات المرتبطة بالطلب، ما لم يوجب القانون خلاف ذلك أو تقرر عزائم أو مزود الخدمة استردادًا استثنائيًا بحسب الحالة.• Cancellation less than eight (8) hours before the fulfilment time: you are not entitled to a refund because preparation has begun and the order has incurred commitments, unless the law requires otherwise, or unless Azayem or the service provider decides on an exceptional refund depending on the circumstances.

إلغاء مزود الخدمةCancellation by the Service Provider

يجوز لمزود الخدمة إلغاء الطلب عند وجود سبب مشروع أو ظرف يمنع التنفيذ. وفي هذه الحالة يُخطر العميل ويُسترد كامل المبلغ المدفوع عن الطلب بما فيه رسوم خدمة عزائم، ما لم يختَر العميل بديلًا مناسبًا ويوافق عليه صراحة. وتحتفظ عزائم بحق اتخاذ الإجراءات التعاقدية المناسبة تجاه مزود الخدمة عند تكرار الإلغاء أو الإلغاء المتأخر دون مبرر مقبول.A service provider may cancel an order where there is a legitimate reason or a circumstance preventing fulfilment. In that case the customer is notified and the full amount paid for the order, including Azayem's service fee, is refunded — unless the customer selects and expressly agrees to a suitable alternative. Azayem reserves the right to take appropriate contractual action against a service provider that repeatedly cancels, or cancels late without an acceptable reason.

مدة الاستردادRefund Timing

تبدأ عزائم أو مزود خدمة الدفع إجراءات الاسترداد بعد اعتماده دون تأخير غير مبرر. ويظهر المبلغ عادة في وسيلة الدفع الأصلية خلال خمسة (5) إلى أربعة عشر (14) يوم عمل، وقد تختلف المدة الفعلية بحسب البنك أو شبكة البطاقات أو مزود خدمة الدفع. ولا يؤثر ذلك في أي مدة إلزامية أقصر يقررها القانون إن وجدت.Azayem or the payment service provider initiates the refund once approved, without undue delay. The amount typically appears on the original payment method within five (5) to fourteen (14) business days, though the actual time may vary by bank, card network or payment service provider. This does not affect any shorter mandatory period prescribed by law, where one exists.

توفر الأصناف والاستبدالItem Availability and Substitution

يلتزم مزود الخدمة بإدارة توفر المنتجات المعروضة وتنفيذ الطلبات المؤكدة. ولا يجوز إجراء استبدال جوهري في نوع الذبيحة أو المنتج أو طريقة الطبخ أو نوع الأرز أو الإضافات المدفوعة أو أي عنصر جوهري في الطلب دون موافقة العميل. وإذا تعذر توفير عنصر جوهري، يُعرض على العميل بديل مناسب إن توفر، وله قبوله أو رفضه وطلب الاسترداد المستحق عن الجزء المتأثر أو الطلب بحسب طبيعة الحالة والحقوق المقررة قانونًا.The service provider is responsible for managing the availability of listed products and for fulfilling confirmed orders. No substantial substitution may be made to the type of zabiha, the product, the cooking method, the type of rice, paid-for extras, or any material element of the order without the customer's consent. If a material item cannot be made available, a suitable alternative may be offered, which the customer may accept or reject, and may request a refund of the amount due in respect of the affected part or of the order, depending on the circumstances and the rights granted by law.

الاستلام والتوصيلPickup and Delivery

خدمة التوصيل، عند اختيارها، يقدمها وينفذها مزود الخدمة (المطعم) وعلى مسؤوليته، ولا تقوم عزائم بذاتها بتقديم خدمات النقل أو التوصيل ولا تتولى تشغيل أو إدارة وسائل أو موظفي التوصيل. ويتحمل مزود الخدمة مسؤولية الطلب أثناء عملية التوصيل، بما في ذلك المحافظة عليه وسلامته وتنفيذ التسليم إلى العنوان والموعد المتفق عليه وفق القوانين والاشتراطات المعمول بها. يلتزم العميل بتقديم عنوان ورقم تواصل صحيحين وتوفر مستلم في الموعد المحدد، وتقتصر مهمة عزائم في هذا الجانب على توفير المنصة التقنية لعرض بيانات الطلب وحالته وتسهيل التواصل المرتبط به. وتظهر رسوم التوصيل، إن وجدت، قبل تأكيد الطلب. ولا يخل ما سبق بأي مسؤولية تقع على عزائم مباشرة بموجب القوانين واجبة التطبيق ولا يجوز قانونًا استبعادها.Where selected, the delivery service is provided and carried out by the service provider (the restaurant) and at its own responsibility; Azayem does not itself provide transport or delivery services, nor does it operate or manage delivery vehicles or personnel. The service provider is responsible for the order during delivery, including preserving and safeguarding it and delivering it to the agreed address and time in accordance with applicable laws and requirements. The customer must provide a correct address and contact number and ensure someone is available to receive the order at the agreed time. Azayem's role here is limited to providing the technical platform for displaying order details and status and facilitating related communication. Delivery fees, where applicable, are shown before the order is confirmed. Nothing here limits any liability falling directly on Azayem under applicable law that cannot lawfully be excluded.

التأخير في التنفيذ أو التوصيلDelay in Fulfilment or Delivery

الأوقات المعروضة للتجهيز أو التسليم تقديرية ما لم يؤكد موعد محدد للطلب. وبما أن التوصيل يقدمه مزود الخدمة (المطعم) وعلى مسؤوليته، فإنه يتحمل مسؤولية التأخير الناشئ عن عملية التوصيل. ويجوز للعميل استخدام المنصة لتقديم شكوى عند التأخير، وتقوم عزائم بتسهيل التواصل ومراجعة المعلومات المتاحة مع مزود الخدمة. وإذا تأخر الطلب أكثر من مئة وعشرين (120) دقيقة عن الموعد المؤكد لسبب يعود إلى مزود الخدمة، يحق للعميل طلب العلاج المناسب بحسب ظروف الطلب والحقوق المقررة قانونًا. ولا يمنع ذلك معالجة التأخير الأقصر إذا أدى إلى عدم صلاحية الطلب للغرض المتفق عليه أو نشأ عنه حق قانوني آخر.Preparation and delivery times shown are estimates unless a specific time is confirmed for the order. Because delivery is provided by the service provider (the restaurant) and at its responsibility, it bears responsibility for delays arising from the delivery process. You may use the platform to raise a complaint about a delay, and Azayem will facilitate communication and review the available information with the service provider. If an order is delayed by more than one hundred and twenty (120) minutes from the confirmed time for reasons attributable to the service provider, you may request appropriate redress according to the circumstances of the order and the rights granted by law. This does not prevent shorter delays being addressed where they render the order unfit for its agreed purpose or give rise to any other legal right.

سلامة الأغذية والذبائحFood Safety and Zabiha

يلتزم مزود الخدمة بالحصول على التراخيص والموافقات والاشتراطات الصحية والبلدية اللازمة لنشاطه، وبأن تكون الذبائح ومصادر اللحوم والتجهيز والطبخ والتخزين والنقل والتوصيل مطابقة للمتطلبات القانونية والصحية المعمول بها. وعندما يعلن مزود الخدمة أن الذبيحة مذبوحة في مسلخ مرخص أو وفق متطلبات محددة، يكون مسؤولًا عن صحة ذلك البيان. ويلتزم بحفظ الأغذية ونقلها وتوصيلها في ظروف آمنة حتى تسليمها للعميل أو المستلم المحدد.The service provider must obtain the licences, approvals, health and municipal requirements necessary for its activity, and must ensure that the zabiha, meat sourcing, preparation, cooking, storage, transport and delivery comply with applicable legal and health requirements. Where a service provider states that a zabiha was slaughtered at a licensed slaughterhouse or according to specified requirements, it is responsible for the accuracy of that statement. Food must be stored, transported and delivered under safe conditions until handover to the customer or the designated recipient.

مسؤولية مزود الخدمةService Provider Responsibility

يتحمل مزود الخدمة، في حدود دوره والتزاماته القانونية والتعاقدية، مسؤولية صحة وصف منتجاته وأسعاره ومكوناته وتوفرها وجودتها وسلامة إعدادها وتغليفها، والحصول على التراخيص اللازمة، وتنفيذ الطلب المؤكد وفق المواصفات والموعد المتفق عليه، مع عدم الإخلال بأي مسؤولية تقع على عزائم أو طرف آخر مباشرة بموجب القانون.Within the limits of its role and its legal and contractual obligations, the service provider is responsible for the accuracy of the description of its products, prices, ingredients, availability, quality and the safety of their preparation and packaging, for obtaining the necessary licences, and for fulfilling confirmed orders to the agreed specification and time — without prejudice to any liability falling directly on Azayem or another party under the law.

دور ومسؤولية عزائمAzayem's Role and Responsibility

تدير عزائم المنصة التقنية وتسهّل عرض مزودي الخدمة والتواصل والطلب والدفع والدعم بحسب الخدمات المتاحة. ولا يعفي أي حكم عزائم من مسؤولية أو التزام لا يجوز استبعاده أو الحد منه قانونًا، بما في ذلك أي التزام يفرضه قانون حماية المستهلك أو تنظيم التجارة الإلكترونية على مقدم المنصة في الحالات التي ينطبق فيها ذلك. وبالقدر الذي يسمح به القانون، لا تتحمل عزائم المسؤولية عن فعل مستقل صادر عن مزود خدمة أو طرف ثالث خارج نطاق سيطرتها الفعلية، مع التزامها بالواجبات التي تقع عليها مباشرة. وبالقدر الذي يسمح به القانون، يقتصر أي حد تعاقدي لمسؤولية عزائم الناشئة مباشرة عن طلب معين على قيمة المبلغ المدفوع لذلك الطلب؛ ولا يسري هذا الحد على الاحتيال أو الخطأ الجسيم أو الوفاة أو الإصابة الشخصية أو انتهاك التزامات حماية البيانات أو أي مسؤولية أخرى لا يجوز قانونًا استبعادها أو الحد منها.Azayem operates the technical platform and facilitates the listing of service providers, communication, ordering, payment and support according to the available services. No provision relieves Azayem of any liability or obligation that cannot lawfully be excluded or limited, including any obligation imposed on a platform provider by consumer protection law or e-commerce regulations in the cases to which they apply. To the extent permitted by law, Azayem is not liable for independent acts of a service provider or third party outside its actual control, while remaining responsible for the duties that fall directly on it. To the extent permitted by law, any contractual cap on Azayem's liability arising directly from a particular order is limited to the amount paid for that order; this cap does not apply to fraud, gross error, death or personal injury, breach of data protection obligations, or any other liability that cannot lawfully be excluded or limited.

الشكاوى ومعالجة النزاعات المتعلقة بالطلبComplaints and Order Disputes

لأغراض سرعة التحقق من حالة المنتجات الغذائية القابلة للتلف، يُطلب من العميل الإبلاغ عن مشكلة الجودة أو المطابقة خلال ساعتين (2) من الاستلام متى كان ذلك ممكنًا، عبر القناة التي توفرها المنصة، مع إرفاق صور أو أدلة توضيحية متى أمكن. تراجع عزائم الشكوى مع مزود الخدمة والأطراف ذات الصلة وتسعى للرد خلال ثلاثة (3) أيام عمل. ويُحدد العلاج، بما في ذلك إعادة التنفيذ أو التعويض أو الاسترداد الكلي أو الجزئي، بحسب طبيعة المشكلة ونتيجة المراجعة والحقوق القانونية. ولا يؤدي انقضاء مدة الساعتين بذاته إلى إسقاط أي حق إلزامي يقرره القانون للمستهلك.In order to verify the condition of perishable food products promptly, customers are asked to report a quality or conformity problem within two (2) hours of receipt, where that is possible, through the channel provided by the platform, attaching photographs or illustrative evidence where available. Azayem reviews the complaint with the service provider and the relevant parties and seeks to respond within three (3) business days. The remedy — including re-performance, compensation, or a full or partial refund — is determined according to the nature of the issue, the outcome of the review and applicable legal rights. The expiry of the two-hour period does not of itself extinguish any mandatory right conferred on consumers by law.

التقييمات والمحتوى المقدم من المستخدمReviews and User-Generated Content

يمكن للعميل تقديم تقييم أو تعليق بعد الطلب. ويجب أن يكون مبنيًا على تجربة حقيقية وألا يتضمن محتوى غير قانوني أو تشهيرًا أو إساءة أو انتهاكًا لحقوق الغير أو بيانات شخصية غير لازمة. ويمنح المستخدم عزائم ترخيصًا غير حصري لعرض المحتوى الذي يقدمه على المنصة لأغراض تشغيل الخدمة وتحسينها، ويجوز لعزائم مراجعة أو تقييد أو إزالة المحتوى المخالف وفق القانون والسياسات المعمول بها، دون التزام بتعديل الرأي المشروع لمجرد كونه سلبيًا.Customers may submit a rating or comment after an order. It must be based on a genuine experience and must not contain unlawful content, defamation, abuse, infringement of others' rights, or unnecessary personal data. You grant Azayem a non-exclusive licence to display the content you submit on the platform for the purpose of operating and improving the service. Azayem may review, restrict or remove content that breaches the law or applicable policies, without any obligation to amend a legitimate opinion merely because it is negative.

العروض وأكواد الخصمOffers and Discount Codes

تخضع العروض وأكواد الخصم للشروط المعلنة لكل عرض، بما في ذلك مدة الصلاحية والحد الأدنى للطلب وعدد مرات الاستخدام والمستخدمين المؤهلين. ولا يجوز استبدالها نقدًا أو الجمع بينها ما لم يُنص على ذلك. ويجوز إلغاء الخصم أو استرداد المنفعة المستخدمة بطريقة احتيالية أو نتيجة خطأ تقني واضح، بالقدر الذي يسمح به القانون ودون الإخلال بحقوق المستهلك حسن النية.Offers and discount codes are subject to the terms announced for each offer, including validity period, minimum order value, number of uses and eligible users. They may not be exchanged for cash or combined unless expressly stated. A discount may be withdrawn, or a benefit used fraudulently or as a result of an obvious technical error reversed, to the extent permitted by law and without prejudice to the rights of good-faith consumers.

الاستخدام المحظور ومكافحة الاحتيالProhibited Use and Anti-Fraud

يُحظر استخدام المنصة بصورة احتيالية أو غير قانونية، أو استخدام وسيلة دفع دون تفويض، أو إساءة استخدام أنظمة الدفع أو العروض أو الحسابات، أو تقديم معلومات أو شكاوى احتيالية عمدًا، أو انتحال هوية الغير، أو محاولة اختراق المنصة أو تعطيلها أو تجاوز ضوابطها الأمنية. ويجوز لعزائم اتخاذ إجراءات معقولة لحماية المنصة والمستخدمين، بما في ذلك التحقق أو تعليق المعاملة أو الحساب، وفق القانون.It is prohibited to use the platform fraudulently or unlawfully, to use a payment method without authorisation, to misuse payment systems, offers or accounts, to knowingly submit false information or complaints, to impersonate others, or to attempt to breach, disrupt or circumvent the platform's security controls. Azayem may take reasonable measures to protect the platform and its users, including verification, or suspending a transaction or an account, in accordance with the law.

التعويض عن إساءة الاستخدام المتعمدةIndemnity for Deliberate Misuse

بالقدر الذي يسمح به القانون، يكون المستخدم مسؤولًا عن الأضرار المباشرة والمعقولة والتكاليف التي تنشأ عن استخدامه المتعمد وغير المشروع للمنصة أو احتياله أو انتهاكه لحقوق الغير أو للقانون، وذلك دون تحميله مسؤولية عن أضرار لا تعود إلى فعله أو عن حقوق لا يجوز قانونًا تقييدها.To the extent permitted by law, you are liable for the direct and reasonable losses and costs arising from your deliberate and unlawful use of the platform, your fraud, or your infringement of the rights of others or of the law, without being held responsible for losses not attributable to your own acts or for rights that cannot lawfully be restricted.

الملكية الفكريةIntellectual Property

اسم عزائم وشعارها وتصاميم المنصة والبرمجيات والنصوص والمحتوى والعناصر المملوكة لها أو المرخصة لها محمية وفق القوانين المعمول بها. ولا يجوز نسخها أو إعادة استخدامها أو استغلالها تجاريًا دون تصريح أو أساس قانوني يسمح بذلك. وتظل العلامات والمحتويات الخاصة بمزودي الخدمة مملوكة لأصحابها وفق حقوقهم.The Azayem name and logo, the platform designs, software, text, content and elements owned or licensed by Azayem are protected under applicable law. They may not be copied, reused or exploited commercially without permission or a lawful basis. Service providers' names and content remain the property of their respective owners.

تعليق أو إغلاق الحسابSuspension or Closure of Accounts

يجوز لعزائم تعليق أو تقييد الحساب أو بعض خصائصه عند وجود أسباب معقولة للاشتباه في الاحتيال أو إساءة الاستخدام أو المخاطر الأمنية أو مخالفة هذه الشروط أو القانون. وتتخذ الإجراءات بصورة متناسبة مع الحالة، ولا يؤثر التعليق في الحقوق أو الالتزامات التي نشأت قبل ذلك، مع مراعاة الحقوق الإلزامية للمستخدم.Azayem may suspend or restrict an account or some of its features where there are reasonable grounds to suspect fraud, misuse, security risk, or breach of these terms or the law. Actions are proportionate to the situation, and suspension does not affect rights or obligations that arose beforehand, subject to the user's mandatory rights.

تعديل الطلب بعد التأكيدAmending an Order After Confirmation

بعد تأكيد الطلب، لا يحق للعميل أو مزود الخدمة تعديل عنصر جوهري فيه، بما في ذلك نوع الذبيحة أو الكمية أو طريقة الطبخ أو الموعد أو عنوان التسليم، إلا من خلال الآلية التي توفرها المنصة وبموافقة الأطراف المعنية. وقد يترتب على التعديل فرق في السعر أو وقت التنفيذ. وإذا تعذر قبول التعديل، يبقى الطلب الأصلي نافذًا ما لم يتم إلغاؤه وفق سياسة الإلغاء والحقوق المقررة قانونًا.After an order is confirmed, neither the customer nor the service provider may amend a material element of it — including the type of zabiha, quantity, cooking method, time or delivery address — except through the mechanism provided by the platform and with the consent of the parties concerned. An amendment may result in a change to the price or fulfilment time. If the amendment cannot be accepted, the original order remains binding unless cancelled under the cancellation policy and applicable legal rights.

يجوز لمزود الخدمة توثيق مراحل تنفيذ وتسليم الطلب من خلال المنصة باستخدام السجلات الإلكترونية المشروعة، مثل وقت قبول الطلب وبدء التجهيز ومحاولات التواصل ووقت الوصول والتسليم. وعند التسليم دون مقابلة العميل، أو عند الحاجة لإثبات واقعة التسليم، يجوز توثيق التسليم بصورة للطلب في موقع التسليم مع وقت التسليم وبيانات الموقع الجغرافي (GPS) بالقدر اللازم والمسموح به قانونًا، أو باستخدام رمز أو تأكيد استلام أو وسيلة إثبات مشروعة أخرى. وتوفر عزائم الأداة التقنية لهذا التوثيق ولا تُعد بذلك مقدم خدمة التوصيل. ولا تمنع هذه السجلات العميل من الاعتراض عليها أو تقديم دليل مخالف، وتُقيّم الشكوى بحسب مجمل الأدلة والحقوق المقررة قانونًا.A service provider may document the stages of fulfilment and handover through the platform using lawful electronic records, such as the time the order was accepted, the start of preparation, contact attempts, and the time of arrival and handover. Where delivery occurs without meeting the customer, or where proof of handover is required, delivery may be documented by a photograph of the order at the delivery location together with the time of delivery and geolocation data (GPS) to the extent necessary and lawful, or by using a code, a handover confirmation, or another lawful means of proof. Azayem provides the technical tool for this documentation and is not thereby a delivery service provider. These records do not prevent a customer from disputing them or submitting contrary evidence, and complaints are assessed on the totality of the evidence and applicable legal rights.

حفظ الأغذية بعد الاستلامFood Storage After Handover

بعد تسليم الطلب للعميل أو المستلم المحدد، يكون العميل مسؤولًا عن التعامل مع الأغذية وحفظها واستهلاكها وفق الإرشادات المناسبة لطبيعتها وخلال مدة آمنة. ولا يتحمل مزود الخدمة أو عزائم الضرر الناتج حصراً عن سوء الحفظ أو التأخير في الاستهلاك بعد التسليم إذا ثبت أن الطلب سُلّم بحالة سليمة، دون الإخلال بأي مسؤولية ناشئة عن عيب أو تلوث أو إخلال سابق على التسليم.After the order is handed over to the customer or the designated recipient, the customer is responsible for handling, storing and consuming the food in accordance with guidance appropriate to its nature and within a safe period. Neither the service provider nor Azayem is liable for harm arising solely from poor storage or delayed consumption after handover where it is established that the order was delivered in good condition, without prejudice to any liability arising from a defect, contamination or a breach occurring before handover.

عمليات الاعتراض على الدفع والاسترداد المكررChargebacks and Duplicate Refunds

إذا قدم العميل اعتراضًا مصرفيًا أو طلب استرجاع مبلغ (Chargeback) عن عملية سبق ردها كليًا أو جزئيًا، أو عن معاملة محل مراجعة قائمة، يجوز لعزائم تقديم سجلات الطلب والتسليم والمراسلات والبيانات اللازمة إلى مزود خدمة الدفع أو البنك بالقدر المسموح به قانونًا للفصل في الاعتراض. ولا يجوز للعميل الحصول على استرداد مزدوج عن المبلغ ذاته، مع بقاء حقه في الاعتراض المشروع على أي عملية غير مصرح بها أو خدمة لم تُنفذ وفق القانون.If a customer raises a bank dispute or chargeback on a transaction that has already been refunded in full or in part, or on a transaction under review, Azayem may submit order, delivery and correspondence records and the necessary data to the payment service provider or bank to the extent permitted by law in order to resolve the dispute. A customer may not obtain a duplicate refund of the same amount, while retaining the right to dispute any unauthorised transaction or any service not performed in accordance with the law.

تعذر استخدام المنصة أو الأعطال التقنيةPlatform Unavailability or Technical Faults

قد تتعرض المنصة لانقطاع مؤقت بسبب الصيانة أو الأعطال أو أسباب تقنية خارجة عن السيطرة المعقولة. ولا يؤثر ذلك على الحقوق التي نشأت عن طلب مؤكد أو مبلغ تم تحصيله. وإذا أدى العطل إلى خصم مبلغ دون إنشاء طلب مؤكد أو إلى تكرار الخصم، تتعاون عزائم مع مزود خدمة الدفع للتحقق من العملية ورد أي مبلغ مستحق وفقًا للقانون وآلية مزود الدفع.The platform may be temporarily unavailable owing to maintenance, faults, or technical causes beyond reasonable control. This does not affect rights arising from a confirmed order or an amount already collected. If a fault results in an amount being deducted without a confirmed order being created, or in a duplicate deduction, Azayem will cooperate with the payment service provider to verify the transaction and return any amount due in accordance with the law and the provider's mechanism.

القوة القاهرةForce Majeure

لا يُعد الطرف مخلاً بالتزامه بالقدر الذي يتعذر فيه التنفيذ أو يتأخر بسبب ظرف خارج عن السيطرة المعقولة، مثل الأحوال الجوية الاستثنائية أو القرارات الحكومية أو الكوارث أو الانقطاع الواسع للخدمات العامة أو التقنية. ويُخطر العميل متى كان ذلك عمليًا، وتُعالج الطلبات التي تعذر تنفيذها وفق طبيعتها والحقوق المقررة قانونًا، بما في ذلك استرداد المبالغ المستحقة عن الجزء غير المنفذ.Neither party is in breach to the extent that performance is prevented or delayed by a circumstance beyond its reasonable control, such as exceptional weather, government action, disasters, or widespread disruption of public or technical services. The customer is notified where practicable, and orders that cannot be fulfilled are handled according to their nature and applicable legal rights, including refunding the amounts due in respect of the unfulfilled portion.

تعديل الشروطAmendments to These Terms

يجوز لعزائم تعديل هذه الشروط عند تطوير الخدمة أو تغير المتطلبات القانونية أو التشغيلية. وتنشر النسخة المحدثة وتاريخ سريانها على المنصة، ويُخطر المستخدم بالتغييرات الجوهرية بوسيلة مناسبة قبل سريانها متى كان ذلك مطلوبًا أو مناسبًا لطبيعة التغيير. ولا تسري التعديلات بأثر رجعي على طلب مؤكد سابقًا إذا كان من شأن ذلك الانتقاص من حقوق نشأت بموجب الطلب أو القانون.Azayem may amend these terms as the service develops or legal and operational requirements change. The updated version and its effective date are published on the platform, and users are notified of material changes by an appropriate means before they take effect where that is required or appropriate to the nature of the change. Amendments do not apply retroactively to a previously confirmed order where doing so would reduce rights arising under that order or under the law.

قابلية فصل الأحكام وعدم التنازلSeverability and No Waiver

إذا تقرر أن أي حكم من هذه الشروط باطل أو غير قابل للتنفيذ، يُفسر أو يُستبعد بالقدر اللازم دون أن يؤثر ذلك على صحة باقي الأحكام. وعدم ممارسة عزائم لأي حق أو تأخرها في ممارسته في حالة معينة لا يعد تنازلًا نهائيًا عن ذلك الحق أو عن ممارسته في حالة لاحقة.If any provision of these terms is held to be invalid or unenforceable, it shall be interpreted or severed to the minimum extent necessary without affecting the validity of the remaining provisions. Azayem's failure to exercise, or delay in exercising, any right in a particular case does not constitute a permanent waiver of that right or of its exercise in a later case.

القانون والاختصاص وتسوية الشكاوىGoverning Law, Jurisdiction and Dispute Resolution

تخضع هذه الشروط وتفسر وفقًا لقوانين دولة الإمارات العربية المتحدة والتشريعات المحلية واجبة التطبيق. وتختص بنظر أي نزاع المحاكم المختصة في دولة الإمارات العربية المتحدة وفقًا لقواعد الاختصاص القضائي المقررة قانونًا، وذلك دون الإخلال بأي حقوق أو قواعد اختصاص إلزامية مقررة للمستهلك بموجب القوانين المعمول بها. ويُشجع العميل على التواصل مع عزائم أولًا لمحاولة معالجة الشكوى وديًا دون أن يكون ذلك شرطًا يحول دون ممارسة حقوقه القانونية.These terms are governed by and construed in accordance with the laws of the United Arab Emirates and applicable local legislation. The competent courts of the United Arab Emirates have jurisdiction over any dispute in accordance with the rules of judicial jurisdiction prescribed by law, without prejudice to any mandatory rights or rules of jurisdiction granted to consumers under applicable law. Customers are encouraged to contact Azayem first in order to attempt to resolve a complaint amicably, without this being a precondition to exercising their legal rights.

حُررت هذه الشروط باللغة العربية، وقد تتوفر ترجمة إلى لغات أخرى للتسهيل. وفي حال التعارض بين النسخ، يُرجع إلى النص العربي بالقدر الذي يسمح به القانون، مع عدم الإخلال بأي متطلب قانوني بشأن اللغة أو المعلومات الواجب تقديمها للمستهلك.These terms are written in Arabic; translations into other languages may be made available for convenience. In the event of a discrepancy between versions, the Arabic text prevails to the extent permitted by law, without prejudice to any legal requirement concerning language or the information that must be provided to consumers.
